Spring-Green Lawn Care Corp. and its parents, affiliates and designees (“we” or “us”) have developed this privacy policy (“Privacy Policy”) to explain our practices in connection with the following: (i) using your Personal Information (defined below) in connection with our provision of lawn, pest, and tree care services; (ii) your use of this website (www.spring-green.com) and other websites (including, www.spring-greenfranchise.com) that we manage or own (individually, the “Site” and collectively the “Sites”); (iii) your use of any software applications made available for use on or through computer and mobile devices (the “App(s)”); and (iv) any other digital communications or content that we may publish that link to this Privacy Policy, including advertisements that we may place on third-party websites such as social media pages (collectively, the “Digital Presence”). This Privacy Policy does not apply to the privacy practices of websites operated, or other services provided, by third parties, regardless of whether we have engaged such third parties as our vendors that assists us in providing products or services to you (each an “Outside Vendor”). Once you leave the Site via a link or access a third-party application or widget, we recommend that you review the applicable privacy policy of that third party to determine how it will handle any Personal Information it collects from you. Certain of our affiliates may have their own websites, and in that case, the privacy policy of those websites shall govern such other websites and will supersede this Privacy Policy.

For purposes of this Privacy Policy, “Personal Information” has the same meaning as the equivalent term defined under applicable laws and does not include certain types of information, such as information that is publicly available or de-identified. Personal Information may include (but is not limited to): (a) contact information (e.g., name, address, phone number, date of birth and email address); (b) credit card information; (c) information regarding certain of your preferences related to us or the Digital Presence; and/or (d) information regarding how you became aware of the Digital Presence. Personal Information may also include information about your activities (such as information about your activity within the Digital Presence, and demographic information, gender, geographic area, and/or service preferences) when any of this information is linked to Personal Information that identifies you.

By accessing or using any of the Digital Presence, you are agreeing to the collection and use of your Personal Information in accordance with this Privacy Policy.

Information We Collect and How We Collect It

Information Provided By You

We collect the information you volunteer to us on our Sites and Apps, such as survey information and/or site registrations or any Personal Information like your name, property address, mailing address, telephone number and/or email address (whether manually entered by you or identified by us through use of a promotional reference number). We may also record certain phone calls you make to us or our affiliates, and keep certain communications logs including text messages, order history, and contacts you have with our customer support agents or franchisees.

By submitting a form that includes your Personal Information on, or otherwise interacting with, our Sites and Apps, you consent to receive marketing text messages (e.g., promotional offers and service reminders) from us at the phone number you provide.

Information Received From Outside Vendors and Other Third-Party Sources

In addition to the Personal Information that we collect directly from your use of any of the Digital Presence, we may have access to other Personal Information from third parties. For example, we may obtain Personal Information from research and analytic companies, marketing partners, public databases, payment processors, mobile carriers, third-party login authentication, and similar third-party sources. We may also receive your Personal Information from our affiliates and representatives, or Outside Vendors.

Cookies & Other Automatically Collected Information

“Cookies” are files that your browser places on your computer’s hard drive, which we may use to assign a unique identification to your computer to learn how you arrived at the Site. Cookies are also used to save and retrieve your email address, password, and preferences so you do not have to re-enter your information each time you visit the Sites. When you visit our Sites, our web server automatically recognizes your domain name (and your email address, if you have a static IP address), which may be recorded in our server logs.

We may also collect and store statistics and other non-personal information about your online activities on an aggregate basis (“Non-Personal Information”). Non-Personal Information is information that we collect about a group of users where the individual users are not personally identifiable or from which individual identities are removed. It includes information such as browser type, system type, page hits, number of visits, web pages viewed and the length of visits to the Sites. We may link your Personal Information to your IP address for purposes of providing relevant information on products, services and offers to you when you revisit any of the Sites. Non-Personal Information is not considered Personal Information as long as it does not directly or indirectly reveal your identity. However, if we combine or connect your Non-Personal Information with your Personal Information so that it can directly or indirectly identify you, we will treat the combined data as Personal Information.

Your web browser may have settings that allow you to transmit a “Do Not Track” signal when you visit various websites or use online services. Like many websites and online services, the Digital Presence is not designed to respond to “Do Not Track” signals received from browsers. Third-Party Use of Cookies and Other Tracking Technologies

Some content on the Sites, including advertisements, are served by third parties such as advertisers, ad networks, content providers and application providers, including certain Outside Vendors we engage. Such third parties may use cookies, alone or in conjunction with other tracking technologies, to collect information about you when you use our Sites. The information collected by third parties may be associated with your Personal Information or may be collected over time across different websites and other online services. This may be used to provide you with Internet-based advertising or other targeted content. We do not control these third parties’ tracking technologies or use of cookies. If you have questions about how an advertisement or other targeted content is provided, you should contact the respective provider directly and review the third parties’ privacy policy.

Personal Information of Children

When you disclose Personal Information on the Sites and/or Apps, you are representing to us that you are 18 years of age or older. With parent or guardian permission, but without providing us with Personal Information, children can access many parts and features of the Sites and Apps. We will not knowingly collect, use, or disclose any Personal Information (as defined by the U.S. Children’s Online Privacy Protection ACT (“COPPA”)) from children 17 years of age or younger.

If a person 17 years of age or younger has provided Personal Information to us, or if you have reason to believe we have information about a person 17 years of age or younger, a parent or guardian should contact us directly using one of the methods in the “Contact Us” section, below, so that we can remove such Personal Information from our active databases. If we become aware that we have received Personal Information from a person aged 17 years or younger, we will delete such Personal Information in accordance with applicable law and this Privacy Policy. We will make a reasonable good faith effort to remove the content from public view or anonymize it so the minor cannot be identified. Please note, however, that this removal process cannot ensure complete or comprehensive deletion from the Internet, as third parties may have republished the content or archived copies of it may be stored by search engines or other parties that we do not control.

How We Use Your Personal Information

We may use the Personal Information we collect from and about you for any or all of the following purposes:

  • To provide you with our and our franchisees’ products and services
  • To provide you with access to the Digital Presence
  • To respond to your requests and inquiries and provide you with information you request
  • To evaluate or process employment applications
  • To establish, manage, and administer customer accounts
  • To process payments for services
  • To improve customer experience, including the content and functionality of the Sites, phone call and text messaging communications, and to conduct analytics and similar processes to better understand our customers and areas in which we offer products and services
  • To market our products and services and special offers to you (in accordance with any privacy preferences you set), including information on new products and services, upcoming events, or updates to our Sites
  • To ensure that the Digital Presence are efficiently and appropriately provided to you based on your preferences
  • For security or fraud prevention purposes, or to fulfill a request by a government agency
  • For any other legitimate business interests we disclose to you
  • For any other purpose to which you consent or direct us

For reasons such as improving your experience at our Sites, personalizing our Sites to you, or providing better service recommendations or special offers that we think may interest you, we may supplement the Personal Information you provide to us with information from third parties.

Our Disclosure of Your Personal Information

Except as described in this Privacy Policy, we do not sell, share, or otherwise disclose personal information about you. Please note that some state-specific statutes may define a “sale” to include sharing of Personal Information with third parties for valuable consideration. We have arrangements with online advertising networks and analytics companies, and such arrangements may potentially be considered sales under these definitions. Please reference our additional notices under “State-Specific Privacy Rights,” below.

When we share Personal Information, our Outside Vendors are required to use such Personal Information according to their contractual obligations to us and their internal terms, conditions, and privacy policies.

We share Personal Information with the following parties:

Company Parties

Your Personal Information will be available to us and our corporate agents, affiliates, representatives, and designees (collectively, the “Company Parties”). In all cases, any Company Party that has access to Personal Information or Non-Personal Information is required to use and protect such information in a manner consistent with this Privacy Policy and to use such information only to carry out the activities or services they are performing for you or for us.

Our Franchisees

We may share your Personal Information with our independently operating franchisees. The Personal Information that is shared between us and our franchisees may include credit card information, name, email address, and mailing address. This sharing takes place to ensure customers receive consistent and accurate services across all locations.

Outside Vendors

Outside Vendors with whom we share Personal Information and/or Non-Personal Information use such information in accordance with their own privacy policies and data processing practices. This means that Outside Vendors may use subcontractors at their discretion to assist with the processing of your Personal Information, in order to meet their obligations owed to us. We are not responsible for the actions of Outside Vendors. However, to our knowledge, we have not contracted with any Outside Vendor who sells or plans to sell Personal Information provided by us for any purpose. The Outside Vendors with which we share Personal Information must also have sufficient security measures in place that, at a minimum, comply with applicable laws, and Outside Vendors are required to use all Personal Information provided to them according to their contractual obligations with us and their company-specific terms, conditions, and privacy policies. To opt-out of the sharing of your Personal Information with any of these third parties, please see the section entitled “Your Privacy Rights,” below.

We share Personal Information with the following categories of Outside Vendors:

Marketing & Advertising Partners. We may provide certain Personal Information such as your name, email, Sites visit history, transaction data (including purchase history), and phone number to Outside Vendors including retailers, marketing agencies, or service providers in the lawn care and related industries, who may provide you with advertisements or offers for products and services we and they believe may interest you.

Communications Platforms. With your prior express written consent upon sign-up, we (or an Outside Vendor we engage, which may use artificial intelligence (“AI”)) may send you SMS text messages. We share information, such as your name and email address, with these third parties. Once we do this, we may tailor advertisements for you on other websites and social platforms by matching your activities or information collected with those collected on Outside Vendor sites.

Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We also engage an Outside Vendor for purposes of streamlining the communication channels we may use to contact you, including texting, voice messaging, email, chat functions, and social media communications. This Outside Vendor provides various metrics on customer communications, some of which are based on conversations you may have with AI platforms. We may separately provide Outside Vendor(s) with audio recordings of customer phone calls or messaging logs from texting or chat messaging, so the Outside Vendor can appropriately analyze these interactions and help us to better the customer experience we provide to you.

Remarketers. We use remarketing tracking cookies and conversion pixels from online Outside Vendors (such as Google, Facebook, Twitter, and LinkedIn) to present special offers to you for products and services. This means you may see advertisements for our products and services after visiting our Sites or Apps. These Outside Vendors may receive Personal Information from us such as your name, email, phone number, and Sites visit history, in order to effectuate the advertising and channel the advertisements through the appropriate channels. In addition, this information can be used to create custom audiences made of certain subscribers and customers, allowing us to present special offers for our products and services to you.

Strategy and Analytics Platforms. We also share Personal Information with Outside Vendors for purposes of sales optimization, strategy, market analysis, and marketing campaigns. These Outside Vendors use the Personal Information we provide to produce statistics, sales predictions, and other data that we use internally to improve customer service and sales relationships. Outside Vendors used for strategy and analytics receive Personal Information from us including but not limited to your name, email, purchase history, Sites visit history, history of call and/or text messaging communications with us, basic employment information (such as affiliation with a business), survey results, and physical address. Certain Non-Personal Information may also be shared with these platforms to create more accurate results, such as cookie identifiers, Site traffic data, communication metadata, and similar items.

To Comply With Laws

Your privacy is very important to us. However, due to the existing legal and technical environment, we cannot ensure that your Personal Information will not be disclosed to third parties in ways not described in this Privacy Policy. For example, we may be required to disclose information to the government or third parties under certain circumstances, or third parties may unlawfully intercept or access transmissions or private communications. Additionally, we can (and you authorize us to) disclose any information about you to private entities, law enforcement or other government officials that we, in our sole discretion, believe is required: (a) by law; (b) to protect and/or defend our property or other legal rights; and/or (c) to protect the personal safety, property, or other legal rights of others. In any event, we cannot and do not guarantee that our franchisees will follow the terms of this Privacy Policy. Therefore, if you provide information to any of these parties, such information will not be subject to the terms of this Privacy Policy.

Business Transactions

We may share Personal Information as needed if we engage in a sale, merger, transfer of our business, or other transaction regarding some/all of our assets, including for the negotiation of any such transaction.

Retention and Security of Your Personal Information

We retain your Personal Information for as long as is reasonably necessary to fulfill the purpose(s) for which it was collected or as otherwise required to be retained under applicable law. We also make commercially reasonable efforts to ensure that the Outside Vendors with which we share Personal Information do not retain or otherwise store such information following the termination of their business or contractual relationship with us.

We will take reasonable precautions to protect your Personal Information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. In some cases, encryption may be available for information you provide to us, and we will notify you if this is the case. However, please note that no system of transmission or storage of data can be 100% secure. Therefore, we cannot guarantee the absolute security of your Personal Information and we are not responsible for any breaches or circumventions of any privacy settings or security measures you set for the Sites. To mitigate any risk of security incidents, please ensure you keep any passwords or other important information we send secure.

Your Privacy Rights

Depending on applicable laws or the jurisdiction you reside in, you may have certain rights regarding your Personal Information, which may include the right to:

  • Access, know about, or confirm that your Personal Information is being processed, including the categories of Personal Information processed, the sources from which the Personal Information is collected, the purpose(s) for collection, the sale or sharing of Personal Information, and the categories of third parties with whom Personal Information is shared or sold.
  • Correct inaccuracies in the Personal Information we collect or maintain about you
  • Delete your Personal Information
  • Opt-out of the sale, sharing, or use of Personal Information, including targeted advertising (as all terms are defined under the privacy laws applicable to you)
  • Appeal any decision made by us with regard to your exercise of your privacy rights
  • Request and receive your Personal Information

The exact scope of these rights may vary by state. Our ability to comply with your request to exercise your rights may be limited in situations where, under applicable law, such information must be maintained to comply with a legal obligation. To exercise any of these rights, please see the “Contact Us” section, below. Residents of certain states may have additional rights regarding their Personal Information. Please see the section entitled “Other State-Specific Privacy Rights,” below.

Accessing and Correcting Your Information

You may review, change, or request the deletion of your Personal Information and preferences at any time by contacting us directly using one of the methods in the “Contact Us” section. We will then take all reasonable efforts to correct or remove your Personal Information from our active database. We may require you to provide us with reasonable evidence to verify that the person making a request to review, change, or delete information is the person about whom we’ve collected the information. Please note that following your request to delete your Personal Information, certain information may be maintained (such as historical service records associated with a physical address), but to the extent we are able, this information will be anonymized and otherwise de-identified from your Personal Information.

Right to Opt-Out

If you choose to opt-out from allowing us to use your Personal Information in the future to provide you with special offers/marketing communications, contact us directly using one of the methods in the “Contact Us” section, below. Additionally, “opt-out” instructions are contained in each special offer/marketing communication sent to you. Upon receipt and processing of an “opt-out” request, we will, within a commercially reasonable amount of time (not to exceed 45 days), remove your information from any listings used to provide you with special offers/marketing communications from us in the future. Please note that we may occasionally contact you for administrative purposes (including, without limitation, billing, as mandated by law for applications of product, newsletters, or customer surveys) even if you unsubscribe from our email list.

Targeted Advertising

If you do not want us to use Personal Information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by contacting us directly using one of the methods in the “Contact Us” section, below.

We do not control third parties' collection or use of your Personal Information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted advertisements from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Cookies & Other Tracking Technologies

You may refuse to accept cookies by activating the appropriate settings on your browser. However, if you select this setting, you may be unable to access certain parts of our Sites. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Sites.

Remarketing

Remarketing of our advertisements is provided by third-party platforms. Opt-out of Twitter remarketing here. Opt-out of Facebook remarketing here. Opt-out of LinkedIn remarketing here. Opt-out of Google remarketing here.

“Do Not Mail” List

We maintain an internal “do not mail” list of existing and prospective customers who request not to receive any marketing materials via U.S. postal mail. This policy only applies to marketing materials; therefore, you will still receive billing statements, legal notices, product updates, and other similar correspondence. To be placed on our “do not mail” list, you must contact us directly using one of the methods in the “Contact Us” section, below, and specify each individual member of the household and each associated address to be added to the “do not mail” list. We generally process these requests within 30 days. However, because our mailings are processed and scheduled for delivery well in advance, you may continue to receive additional offers for some time after your request to us to be added to the “do not mail” list. In addition, we may direct marketing mail to certain neighborhoods or ZIP codes, addressed to “Homeowner,” “Resident” or similar. These offerings are delivered to all homes in a neighborhood or ZIP code. You may continue to receive this type of marketing mail even if you opt-out of receiving marketing related postal mailings from us. We may modify this procedure or discontinue the “do not mail” list at any time.

Other State-Specific Privacy Rights

  • opt-out of the sale of Personal Information (although we do not “sell” your Personal Information as defined under Virginia privacy law, and as such this right is not applicable)

Exercising State-Specific Privacy Rights

We may require you or your authorized representative to verify your request by providing us with additional information, including providing us with information to verify your identity before disclosing any Personal Information to you. This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. You may only submit a request to access your Personal Information twice within a 12-month period. You do not need to create an account with us to submit a request to access or erase your Personal Information.

We try to respond to all legitimate requests within 45 days. Occasionally it could take us longer than 45 days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated. We do not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. If we refuse to process your request for any reason, you may appeal our decision by writing to us. We will respond to your appeal, disclosing any actions (or inactions) taken in response to the appeal and an explanation for the decisions.

We will not discriminate against you for exercising any of your rights under any applicable state laws. Unless permitted by the applicable state law(s), we will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you a different level or quality of goods or services; or (iv) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.  However, we may offer you certain financial incentives permitted by the applicable state laws that can result in different prices, rates, or quality levels. Any financial incentive we offer that is permitted under the applicable state laws will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

During the preceding 12 months, we have collected each of the categories of Personal Information we describe in the Privacy Policy above, but we have not sold Personal Information to third parties.

We are headquartered in the United States, and we intend for the Digital Presence to be used exclusively in the United States, by United States residents. By using the Digital Presence, you consent to the transfer, storage, and processing of all Personal Information we collect in the United States.

Changes to Our Privacy Policy

This Privacy Policy may change from time to time. If we make a material change to how we treat your Personal Information, we will notify you by email to the email address on file for your account and/or through a notice on the Sites’ home page(s). Revisions to the Privacy Policy will be shown in the effective date at the top of the Privacy Policy, so you should ensure you are checking back periodically. Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
